INFFNI Terms of Service
Thank you for choosing the products and services provided by Shenzhen Yuejiang Technology Co., Ltd. (hereinafter referred to as "Yuejiang," "we," or "us").To enable you to lawfully and compliantly use the products and services we provide outside the mainland territory of the People's Republic of China, you shall read and comply with this INFFNI ROVER User Service Agreement (hereinafter referred to as the "Agreement"), together with the INFFNI ROVER Privacy Policy and other related agreements.Please be sure to read this Agreement carefully and fully understand all provisions herein, especially those provisions that exempt or limit our liability, restrict user rights, or stipulate dispute resolution methods and jurisdiction. Provisions that impose limitations, exclusions of liability, or otherwise involve your material rights and interests may be highlighted by bold text, underlining, or other prominent formats to draw your attention.
Definitions and Explanations:
1.NFFNI ROVER X1 Product: Refers to a biomimetic quadruped robot independently developed and manufactured by Yuejiang Technology, capable of executing various commands such as walking, running, and standing, and equipped with multiple functions including voice interaction and autonomous following. This term also includes related accessories sold together with the robot, such as power adapters, batteries, spare consumables, and other accessories. Hereinafter referred to as the "Hardware" or the "Product."
2.INFFNI ROVER APP: Refers to a mobile client application software independently developed by Yuejiang Technology to facilitate users' more convenient use of the Product. Through the App, users may issue commands to the Product to control its movement, photography, following, and other functions. Hereinafter referred to as the "Client" or the "Service."
3.Product and/or Services: Refers collectively to the Hardware, the Client, and all components included therein, such as interfaces, firmware, and other related elements, as described above. Hereinafter collectively referred to as the "Product and/or Services."
4.Terminal Device: Refers to any device or product capable of establishing a connection with the Product and/or Services (including wired connections or wireless connections via Wi-Fi, Bluetooth, or other technologies) and capable of controlling the Product, including but not limited to mobile phones, computers, and handheld remote controllers.
5.Product Manual and Warranty Card: Refers to the documents sold together with the Hardware that describe the Hardware's functions, instructions for use, precautions, maintenance, and other related information.
6.User: Refers to any natural person, legal entity, or other organization that actually uses or operates the Product and/or Services through the Client or a Terminal Device. Hereinafter also referred to as "you."
7.Open Source License: Refers to any software license that qualifies as an open-source license, or any substantially similar license, including but not limited to licenses that require distributors to provide software in source code form as a condition for permitting distribution.
I. About This Agreement
1. Scope and Amendment of the Agreement
iThis Agreement constitutes an agreement entered into between you and Yuejiang regarding the use of the Product and/or Services. Where necessary, we may revise this Agreement from time to time and make such revisions public through announcements on our official website or other appropriate channels.
iiIn addition, any agreements, business rules, or activity guidelines that we may publish or update from time to time shall form an integral and inseparable part of this Agreement, and you shall comply with them accordingly.
iiiYour continued use of the Product and/or Services shall be deemed as your acknowledgement and acceptance of any revisions or amendments to this Agreement, as well as your agreement to comply with any agreements, business rules, or activity guidelines published or updated by us from time to time. If you do not agree to such revisions, amendments, or related rules, you shall immediately cease using the Product and/or Services.
2. Territorial Scope
iThe primary service scope of the Product and/or Services is outside the mainland territory of the People's Republic of China.
iiIf the laws or regulations of your country or region prohibit the application of all or part of this Agreement, you shall immediately discontinue use of the Product and/or Services. Otherwise, your continued use of the Product and/or Services shall be deemed as your agreement to assume all related legal risks and liabilities arising therefrom.
3. Severability
iIf any provision of this Agreement is determined to be partially invalid or unenforceable for any reason, such invalidity or unenforceability shall not affect the validity of the remaining provisions, which shall remain legally binding upon both you and Yuejiang.
4. Modification, Suspension, and Termination of Services
i Yuejiang reserves the right to modify, suspend, or terminate part or all of the Services at any time, without bearing any liability to you or any third party as a result thereof.
5. Termination
iThis Agreement shall enter into effect upon your acceptance thereof and shall remain effective until terminated. If you begin using the Services prior to formally accepting this Agreement, this Agreement shall be deemed effective from the time of your first use of the Services.
iiYuejiang has the right to terminate this Agreement at any time, including where Yuejiang reasonably believes that you have violated applicable use policies or the provisions of this Agreement. Where you infringe upon the intellectual property rights of any third party or engage in illegal or non-compliant activities, Yuejiang has the right to terminate this Agreement either proactively or upon notice from the relevant right holder or governmental authority.
iiiUpon termination of this Agreement, your right to use the Services shall immediately terminate, and related data may be deleted. Yuejiang shall not bear any liability to you as a result thereof.
II. Rules for Use
1. Rules for Use of the Hardware
iPrior to using the Product and/or Services, you confirm that you have carefully read the product manual and warranty documents, fully understand the Product's functions, methods of use, and precautions, and undertake to use the Hardware strictly in accordance with the product manual and legal statements. Any damage caused by your failure to comply with the product manual or legal statements shall be borne solely by you.
iiWe do not recommend that you allow any third party to use the Product and/or Services. If you nevertheless permit a third party to use the Product and/or Services, you shall ensure that such third party has read and understood the product manual and legal statements and is proficient in the Product's functions and operation. You shall bear full responsibility for any use of the Product and/or Services by such third party.
2. Rules for Use of the Client
iPrior to use, you shall download and install the Client (or any updated version) exclusively from Yuejiang's designated official website. You shall not download or install the Client through any non-designated channels, so as to avoid losses caused by malware or other malicious programs. If you obtain the Client from any unauthorized third party, Yuejiang does not guarantee the normal operation of the software and shall not bear any adverse consequences arising therefrom.
iiYou must select a software version compatible with the corresponding Hardware model. Any software issues, hardware issues, or damages caused by version incompatibility shall be borne solely by you.
iiiIn order to improve user experience and enhance service content, Yuejiang reserves the right to provide replacement, modification, or upgraded versions of the Client from time to time, or to update or optimize certain functions or services. Yuejiang may charge fees for such adjustments, subject to your prior consent. After a new version is released, Yuejiang does not guarantee the continued availability of earlier versions of the Client.
ivUnless expressly provided otherwise, any new features that enhance or strengthen the existing Product and/or Services, as well as any newly added products and/or services, shall be unconditionally subject to this Agreement.
3. Rules for Account Use
iRegistration and Cancellation
a. You must register a Yuejiang service account in order to use the Services. The registration and login procedures shall be subject to the on-screen instructions. After logging in, you shall complete the network configuration process in accordance with the on-screen guidance before using the Product and/or Services.
b. Ownership and all rights in the service account belong to Yuejiang. Upon successful registration, you are granted only a right to use the account. The account is for your personal use only and may not be gifted, loaned, leased, transferred, sold, or otherwise made available to others in any form without Yuejiang's prior written consent. If Yuejiang has reasonable grounds to believe that the actual user is not the original registrant, Yuejiang has the right to suspend or terminate services provided to the account and to cancel the account, without bearing any legal liability to the registrant.
c. You have the right to apply for account cancellation in accordance with Yuejiang's published account termination procedures. Yuejiang reserves the right to reclaim accounts that have not been logged into for an extended period in order to avoid waste of resources. Any losses arising therefrom shall be borne by you.
iiYour Representations and Warranties
a. The registration information you submit shall be lawful, true, accurate, and complete.
b. Your use of the Product and/or Services shall comply with applicable laws and regulations, as well as Yuejiang's relevant agreements and policies.
c. You shall keep your account login information confidential and shall bear full responsibility for all activities conducted under your account. Upon discovering any unauthorized use or suspected unauthorized use, you shall immediately notify Yuejiang. Any losses resulting from your failure to fulfill the foregoing obligations shall be borne by you, and Yuejiang shall not bear any liability.
d. If you use the Hardware in household or other scenarios involving persons other than yourself, you shall ensure that the actual users have fully read and agreed to all provisions of this Agreement. You shall bear full responsibility for such users' actions and the consequences thereof. Yuejiang reminds you to strictly limit others' use of the Product to avoid adverse consequences.
e. You agree and authorize Yuejiang, prior to and during the provision of the Services, to lawfully inquire with or verify necessary information about you through relevant authorities or organizations.
4. User Conduct Rules and Precautions
i You may use the Product and/or Services only in compliance with applicable laws and regulations and Yuejiang's relevant agreements and rules.
ii Without Yuejiang's prior express written consent, you shall not engage in any of the following acts, whether for commercial purposes or otherwise:
a. Removing, altering, or circumventing copyright notices, information, or technical protection measures established to protect intellectual property within the Product and/or Services;
b. Reverse engineering, decompiling, or otherwise attempting to obtain the source code of the Product and/or Services;
c. Unauthorized modification, falsification, or interference with instructions or data during the operation of the Product and/or Services, or adding, deleting, or altering functions or operational effects, or developing, operating, or distributing software or methods for such purposes;
d. Using the Product and/or Services to engage in activities that endanger network security, including but not limited to unauthorized probing, scanning, or testing of system or network vulnerabilities; interfering with or disrupting normal service operation; intentionally spreading malicious programs or viruses; forging TCP/IP packet names, etc.;
e. Using the Product and/or Services to engage in any activities that violate laws or regulations, endanger national security or public interests, or infringe upon the lawful rights and interests of others (including privacy, personal information, intellectual property, and trade secrets);
f. Logging into or using the Product and/or Services through third-party tools, code, or systems not developed, authorized, or recognized by Yuejiang, or creating, publishing, or disseminating such tools;
g. Without Yuejiang's prior written consent, renting, lending, copying, modifying, linking, reproducing, compiling, publishing, distributing, establishing mirror sites for the Product and/or Services, or using the Product and/or Services to develop derivatives, plug-ins, add-ons, cheats, or interconnection services;
h. Using the Product and/or Services for the purpose of creating identical or competing services;
i. Collecting information or data of other users without authorization;
j. Attempting to access server data or communication data of the Product and/or Services without authorization;
k. Interfering with or disrupting other users' normal use of the Product and/or Services;
l. Using the Product and/or Services in any unlawful, non-compliant, or Agreement-inconsistent manner;
m. Any other acts not expressly authorized by Yuejiang;
n. Any other acts prohibited by laws or regulations.
iii You shall bear all legal liabilities arising from illegal or improper use of the Product and/or Services. Yuejiang shall not be liable for consequences directly caused by your personal actions, except as otherwise required by law.
iv When using the Services, you shall comply with the laws and regulations of your location and respect local morals and customs, and shall independently bear any liability arising from violations. If your use of the Services causes Yuejiang to face legal risks or become involved in political or public incidents, Yuejiang has the right to suspend or terminate the provision of Services to you.
v You acknowledge and agree that you shall independently bear responsibility for all actions under your account. You shall independently assess content and assume corresponding risks, including but not limited to risks arising from reliance on the accuracy, completeness, or usefulness of such content. Yuejiang shall not bear any liability in this regard.
vi If you violate applicable laws, regulations, or this Agreement, Yuejiang has the right, based on reasonable judgment, to take measures such as issuing warnings, restricting or terminating part or all functions, freezing accounts, and reserves the right to report to competent authorities, cooperate with investigations, and pursue legal liability in accordance with law. You shall bear all legal consequences arising therefrom.
vii You shall ensure that valid and commonly used contact information is provided in your account. If notices cannot be delivered due to invalid contact information, the relevant risks shall be borne by you. Notices issued by Yuejiang via product announcements, in-platform notifications, emails, or push messages shall constitute effective service.
5. FeesIn order to provide effective services, the Product and/or Services may consume resources of your terminal device, such as processor capacity and bandwidth. During use, data traffic fees, communication fees, information fees, and other charges may be incurred. You shall independently consult with telecommunications operators or other third parties regarding applicable fees and shall bear such costs yourself.
III. Software License
1. Grant of License
i. During your use of the Services, you may be required to download certain software. Yuejiang hereby grants you a personal, non-transferable, non-exclusive license to use such software solely for the purpose of using the Services.
ii. Except as expressly authorized under this Agreement, no other rights or interests in the software are granted to you.
2. Software Updates
i. In order to improve user experience, ensure security, and maintain functional consistency, Yuejiang may update the software from time to time.
ii. You shall promptly install the latest version of the software. Failure to do so may result in the inability to properly use certain Services, for which Yuejiang shall not be liable.
3. Version Selection and Source
i. Yuejiang may provide different software versions for different devices. You shall select and install the appropriate version based on your actual circumstances.
ii. It is recommended that you obtain the software from Yuejiang's official website or authorized channels. For software obtained from unauthorized sources, Yuejiang does not guarantee normal operation and shall not bear any losses arising therefrom.
4. Restrictions on Use
Without Yuejiang's prior written permission, you shall not engage in any of the following acts:
i. Removing copyright notices or other proprietary rights information from the software or any copies thereof;
ii. Reverse engineering, reverse assembling, decompiling, or otherwise attempting to obtain the source code of the software;
iii. Using, leasing, lending, copying, modifying, linking, reproducing, compiling, publishing, distributing, or establishing mirror sites for any content in which Yuejiang holds intellectual property rights;
iv. Copying, modifying, adding to, or deleting data generated during the operation of the software, or accessing the software or related systems through unauthorized plug-ins, add-ons, or similar means;
iv. Modifying or falsifying software operation instructions or data, altering software functions or effects, or disseminating related tools or methods;
v. Logging into or using the Services through tools or systems not developed or authorized by Yuejiang, or creating, publishing, or disseminating related third-party tools;
vi. Interfering with the normal operation of the software, modifying or falsifying instructions, data packets, or otherwise altering software functions or effects, or disseminating related tools;
vii. Any other unauthorized, unlawful, or Agreement-inconsistent use of the software.
5. Third-Party Technologies
i. Where any dispute arises from third-party technologies integrated into the software, such dispute shall be resolved by the relevant third party, and Yuejiang shall not bear any liability in this regard.
ii. Any technical support related to such third-party technologies shall be obtained directly from the respective third-party providers.
IV. Open Source Components
1. Use and Modification Risk
i. Certain components of the Product and/or Services are provided under applicable open source licenses. You acknowledge and agree that any modification of such components by you may affect the normal operation of the Product. You shall exercise due caution when making any such modifications.
ii. Yuejiang shall not bear any liability, and will not provide any technical support or after-sales service, where the Product fails to function properly due to your modification of any open source components.
2. Applicable Open Source Licenses and Priority
i. Relevant open source components are subject to licenses including, without limitation, Apache License 2.0, GPL v2, and EPL 2.0.
ii. In the event of any conflict between the terms of an open source license and this Agreement, the open source license shall prevail. Where an open source license prohibits certain restrictions set forth in this Agreement, such restrictions shall not apply to the relevant open source component.
iii. You shall carefully read and comply with the applicable open source license terms.
3. Your Responsibility; Limitation of Liability
i. You shall bear sole responsibility for your use, modification, secondary development, distribution, and any other handling of open source components. Yuejiang shall not bear any liability to you or any third party in connection with any such actions, and shall not be deemed to have assumed any liability merely because Yuejiang becomes aware of such actions, including without limitation:
a. Any consequences arising from any data, content, or resources created, transmitted, or displayed through the use of open source components or applications developed based thereon, including software/hardware damage, data loss, service failures, and any losses suffered by Yuejiang as a result;
b. Any acts in violation of this Agreement, any third-party license, or applicable laws and regulations, and any consequences thereof.
V. AI Services
1. AI-Generated Content and Labeling
i. Certain services or functions provided by the Product and/or Services may involve generated, synthesized, or AI-generated content. In order to promote transparent use of AI-generated content and to comply with applicable laws and regulations relating to deep synthesis and generative AI services (if any), we will add explicit labels on relevant interfaces or within/near relevant generated content, and will implement necessary implicit labeling measures in accordance with law.
ii. You shall carefully read and understand the relevant labeling and identification requirements, and you shall not use such services to create, publish, or disseminate false, infringing, or otherwise illegal or non-compliant information.
2. Form of Explicit Labels
i. Explicit labels are typically displayed in the form of wording such as "AI-generated," "AI-powered," or other similar language indicating AI elements, on the interaction interface or near the generated content.
3. Special Notice and Disclaimer
i. All content provided through the above services is generated based on AI models and may contain errors or omissions. The Services make no warranties as to the accuracy, completeness, or functional availability of such content, and any generated content does not represent Yuejiang's views or positions.
ii. Where you use such Services to consult on professional matters such as medical or legal issues, the relevant content is provided for reference only and does not constitute medical diagnosis, legal advice, or any other professional advice. If professional judgment or decision-making is required, you shall consult qualified professionals with appropriate credentials. You shall independently assume all risks arising from your use of such Services, and Yuejiang shall not bear any liability arising therefrom.
VI. Risk Notice and Disclaimer
1. General Risks
i. The Product and/or Services may be affected by various factors including user operations, network environments, and social environments, and may be exposed to various security risks. You shall enhance your information security awareness, properly safeguard your account and passwords, and take reasonable measures to avoid losses.
2. Technical Limitations
i. Except as expressly required by applicable laws and regulations, Yuejiang shall prudently adopt technical measures in accordance with industry standards to safeguard the security, effectiveness, and accuracy of the Product and related technologies. However, due to limitations of existing technologies, Yuejiang makes no warranties in this regard.
3. No Warranty
i. The Product and/or Services expressly disclaim any warranties, whether express or implied, including but not limited to warranties as to timeliness, security, or accuracy.
4. Limitation of Liability
Yuejiang shall not bear any liability under any of the following circumstances:
i. Any damage to you or any third party arising from your failure to use the Product and/or Services in accordance with the product manual;
ii. Any personal information leakage caused by your improper use;
iii. Any damage to you caused by third parties using the Product and/or Services, or any unauthorized alteration of your data;
iv. Any damage arising from your operational errors or misunderstanding of the Product's functions;
v. Any damage caused by your unauthorized addition, deletion, or modification of the Product's software, code, systems, or functions;
vi. Any service interruption or obstruction caused by force majeure events such as hacker attacks, virus intrusions, illegal information, governmental controls, network failures, or technical failures;
vii. Any losses caused by failures or force majeure events relating to third parties (such as telecommunications operators), including line, equipment, or system failures;
viii. Any issues arising from third-party software or services integrated into the Product and/or Services;
ix. Any acts by you that are restricted or prohibited under this Agreement;
x. Any other losses related to the Product and/or Services that are not attributable to Yuejiang.
VII. Intellectual Property Rights
1. Ownership
i. Yuejiang is the owner of the intellectual property rights in and to the Product and/or Services. Except for portions lawfully licensed from third parties, all intellectual property rights involved in the Product and/or Services, including but not limited to copyrights, trademark rights, patent rights, trade secrets, and related information content (including text, images, audio, video, interface designs, and data files), are owned by Yuejiang.
2. Restrictions on Use
i. Without Yuejiang's prior written consent, you shall not use, authorize any third party to use, or transfer the foregoing intellectual property rights for any purpose. Yuejiang reserves the right to pursue legal liability in accordance with law.
3. User-Provided Content
i. Any content provided or uploaded by you during use of the Product and/or Services shall not result in the transfer of intellectual property rights, portrait rights, or any other related rights by virtue of such provision or upload.
VIII. Export Controls
1. Compliance Commitment
i. You undertake to strictly comply with all applicable economic sanctions and export control laws and regulations.
2. Restricted Destinations and Parties
i. Without prior authorization from the relevant governmental authorities and Yuejiang's prior written consent, you shall not directly or indirectly export, re-export, transship, or resell any purchased products to:
a. Countries or regions subject to comprehensive embargoes or similar sanctions;
b. Any entities or individuals listed on restricted or denied party lists, including but not limited to the U.S. Department of the Treasury's OFAC sanctions lists (such as the SDN List), the U.S. Department of Commerce Entity List, the EU Consolidated Sanctions List, the UK Sanctions List, the United Nations Sanctions List, or any other restricted party lists issued by governmental authorities.
3. Prohibited End Uses
i. You shall not use the Product and/or Services for any military purposes, or for supporting terrorism, nuclear technology, chemical or biological weapons, missiles, or other weapons of mass destruction.
4. Remedies
i. If Yuejiang determines that you have violated this Section or applicable laws and regulations, Yuejiang has the right to suspend or terminate the Services without liability, and you shall compensate Yuejiang for all losses incurred as a result.
IX. Special Provisions Regarding Minors
1. Age Requirement
i. The core intended users of the Product and/or Services are adults. If you have not reached the minimum age required by applicable laws in your jurisdiction, you shall not register for or use the Product and/or Services unless your legal guardian has read and agreed to this Agreement and, to the extent required by applicable law, has completed the necessary consent or authorization procedures on your behalf.
ii. If you lack full civil capacity due to age, intellectual ability, or other factors, you shall read this Agreement and use the Product and/or Services under the accompaniment and guidance of your guardian.
2. Safety Guidelines for Minor Users
i. Minor users shall enhance safety awareness and self-protection, and in particular shall comply with the following requirements:
a. Avoid excessive or addictive use of the internet and reasonably plan the time spent using the Product;
b. Exercise caution when providing personal information and guard against the risk of personal data leakage;
c. Learn proper internet usage and correct use of the Product under the guidance of guardians or teachers;
d. Avoid meeting strangers met online or participating in offline social activities at will, and effectively protect personal safety.
3. Responsibilities of Guardians and Schools
i. Guardians and schools shall actively fulfill their guidance obligations to support minors' healthy use of the internet. Guardians, in particular, shall strengthen communication with minors and reinforce usage guidance.
4. Reference Application
i. Users who have reached the minimum age required by applicable laws in their jurisdiction but do not have full civil capacity shall refer to and be subject to the relevant provisions applicable to minors under this Section.
X. Indemnification
1. Indemnity Obligation
i. Where Yuejiang suffers third-party complaints, claims, lawsuits, losses, or damages as a result of any of the following acts, you shall bear full responsibility and indemnify Yuejiang for all related losses (including reasonable attorneys' fees and costs):
a. Your use of the Product and/or Services;
b. Your modification, deletion, or secondary development of the software, systems, or code of the Product and/or Services.
2. Defense and Settlement
i. In the event that you breach this Agreement, Yuejiang reserves all rights of defense and claims for compensation.
ii. Without Yuejiang's prior written consent, you shall not independently settle any matter in which you and Yuejiang are co-defendants or joint parties to a proceeding.
iii. Yuejiang shall provide reasonable notice to you regarding the progress of any such proceedings.
3. Limitation of Damages
i. Under no circumstances shall Yuejiang be liable to you or any third party for any indirect, consequential, incidental, special, or punitive damages arising out of or in connection with the use of the Product and/or Services.
ii. Any risks of device damage, data loss, or other damages arising from your use of the Product and/or Services shall be borne solely by you.
XI. User Feedback and After-Sales Support
1. Feedback Ownership and Use
i. Any suggestions, comments, improvement proposals, or other feedback provided by you regarding the Product and/or Services (collectively, "Feedback") shall be deemed as your gratuitous assignment of all related rights in such Feedback to Yuejiang. You agree that Yuejiang may use such Feedback and related information in any manner.
ii. Such Feedback shall be deemed non-confidential and non-proprietary. You represent and warrant that you will not provide Yuejiang with any information that you or any third party considers confidential or proprietary.
2. After-Sales Service Channels
i. Where the Product experiences a malfunction covered by the warranty, or where you require consultation on other after-sales matters, you may apply for service through any of the following channels:
a. Log in to the Client and submit a fault description and relevant supporting materials via "My – App Settings – Feedback";
b. Visit Yuejiang's official website and submit an online request via "Service Support–After-Sales Service";
c. Send an email to Yuejiang's after-sales service mailbox at：service@inffnitech.com.
3. Response Time and Resolution
i. Yuejiang shall respond within three (3) business days after receiving your request and, upon confirmation of the malfunction, shall provide repairs or other reasonable solutions in accordance with the applicable arrangements.
XII. Miscellaneous
1. Governing Law and Jurisdiction
i. The formation, validity, performance, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the mainland territory of the People's Republic of China.
ii. The place of execution of this Agreement is Shenzhen, Guangdong Province, PRC. The Parties shall first attempt to resolve disputes through friendly consultation. If such consultation fails, either Party may bring a lawsuit before a people's court with jurisdiction at the place of execution of this Agreement.
2. Headings and Severability
i. Section headings are included for convenience of reference only and shall have no legal effect.
ii. If any provision of this Agreement is held to be invalid, such invalidity shall not affect the validity of the remaining provisions. The invalid provision shall be amended, to the extent permitted by law, to achieve legal validity as closely as possible to its original intent.
3. Assignment
i. Without Yuejiang's prior written consent, you shall not assign or transfer any of your rights or obligations under this Agreement.
4. Contact Information
